Terms of Service
These Terms of Service ("Terms") are an agreement between you and Tobie Town Media, LLC ("ClickListing," "we," "us"), and govern your use of the ClickListing app, website, and photo-editing service (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who can use ClickListing
You must be at least 18 years old and able to enter into a binding contract. ClickListing is built for real-estate professionals and others who have the right to photograph and market the properties they submit. By using the Service, you represent that you meet these requirements.
2. Your account
You are responsible for the information you provide, for keeping your login credentials secure, and for everything that happens under your account. Let us know promptly at support@clicklisting.app if you believe your account has been used without your permission.
3. How the Service works
You capture photos of a property with the app, submit them, and pay per photo. Your images are professionally edited and returned to you, typically within 12 hours. Editing is performed by a third-party editing provider on our behalf. Turnaround times are estimates, not guarantees, and may vary with volume or factors outside our control.
The quality of the finished photos depends in part on the quality of what you capture. We are not responsible for images that cannot be adequately edited because of how they were shot (for example, severe blur, motion, or missing coverage).
4. Pricing and payment
- Photos are billed per photo at the price shown in the app at the time you submit.
- Payments are processed by our payment provider, Stripe. When you submit a listing, a hold is placed on your payment method, and you are charged only once your photos have finished uploading. If an upload is canceled or fails, the hold is released and you are not charged.
- You are responsible for any taxes that apply to your purchase.
- Prices may change over time; the price that applies to any order is the one shown in the app when you submit that order.
5. Refunds and re-edits
If a finished photo is not MLS-ready, contact us at support@clicklisting.app (or use Send Feedback in the app) and we will re-edit it free of charge. If the re-edited photo still is not right, we will refund the amount you paid for that photo. Because each photo is individually produced for you, orders are otherwise non-refundable once editing has begun. We may issue a broader refund — including for an entire listing — where we determine it is appropriate, or where required by law.
6. Your content and the rights you grant us
You keep ownership of the photos and property information you submit ("Your Content"). You grant ClickListing and our editing and hosting providers a limited license to store, process, edit, and deliver Your Content for the purpose of providing the Service to you.
You represent that you have the right to photograph each property and to submit and use Your Content, and that doing so does not violate any law or any other person's rights.
7. Acceptable use
You agree not to misuse the Service. In particular, you will not:
- use the Service for any unlawful purpose or in violation of these Terms;
- submit content you do not have the right to submit;
- attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service or its systems;
- use the finished photos in a way that is deceptive or that violates applicable real-estate advertising rules, MLS rules, or disclosure requirements. You are responsible for how you market and disclose the properties you list.
8. Photo storage and retention
Finished photos and their associated project data are automatically deleted approximately 30 days after delivery. Please download and save anything you want to keep before then. See our Privacy Policy for more on how we handle your information.
9. Third-party services
The Service relies on third parties — including Apple, Stripe, Dropbox, our photo-editing provider, Resend, and Render — and your use of the Service may be subject to their terms. We are not responsible for the acts or omissions of these providers.
10. Our intellectual property
The ClickListing app, website, brand, and software are owned by Tobie Town Media, LLC and are protected by intellectual-property laws. These Terms do not give you any right to our name, logos, or software except the limited right to use the Service as intended.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that finished photos will meet every expectation.
12. Limitation of liability
To the fullest extent permitted by law, ClickListing and Tobie Town Media, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the order giving rise to the claim.
13. Indemnification
You agree to indemnify and hold harmless ClickListing and Tobie Town Media, LLC from any claims, losses, or expenses arising out of Your Content, your use of the Service, or your violation of these Terms or of any law or third-party right.
14. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we need to for legal, security, or operational reasons. Provisions that by their nature should survive termination (such as payment obligations, disclaimers, and limitation of liability) will survive.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and post the new version here. Your continued use of the Service after a change means you accept the updated Terms.
16. Governing law
These Terms are governed by the laws of the State of Mississippi, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Mississippi, and you consent to their jurisdiction.
17. Apple App Store
If you download ClickListing from the Apple App Store, the following also applies:
- These Terms are between you and Tobie Town Media, LLC only, not with Apple. Apple is not responsible for the app or its content.
- Your license to use the app is a limited, non-transferable license to use it on Apple-branded products you own or control, as permitted by the App Store Terms of Service.
- Apple has no obligation to provide maintenance or support for the app. We are solely responsible for support, at support@clicklisting.app.
- We, not Apple, are responsible for any product warranties and for addressing any claims relating to the app (including product-liability, legal, regulatory, or intellectual-property claims).
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
- You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.
